“An Invitation to Struggle: War Powers and the Constitution”

The Constitution’s allocation of war powers and control of the military has famously been referred to as “an invitation to struggle.” This Constitution Day, we will explore how (and why) this struggle was created, its implications for US policymakers, and the ways in which the Executive uses the US military and militias, the ways in which Congress can balance those powers, and how and where the US military can be utilized at home and abroad.
