Maternity Leave and Nursing Mothers

You are here

Maternity Leave

A short-term disability for maternity adheres to the same requirements, procedures and benefits for all other medical conditions related to personal, non-work-related illnesses or injuries. A short-term disability for maternity begins when your licensed health care provider certifies that you are not able to work, and it ends when your licensed health care provider determines that you are able to return to work based on your ability to perform the essential requirements of your position. Please refer to the short-term disability policy in the manual on the MyIU portal for more specific information.

In addition, based on employment status and length of service, you may be eligible for FMLA leave for the birth, adoption, and/or care of a newborn child. Please refer to the family and medical leave policy, which can be found on the MyIU portal. To request maternity leave, please contact the Office of Human Resources at 484-323-3078.

Guidelines for Nursing Mothers

Under the Patient Protection and Affordable Care Act (PPACA), employers must provide “a reasonable break time for an employee to express breast milk for her nursing child for one year after the child’s birth each time such employee has a need to express the milk.”

In addition, the PPACA requires employers to provide space for nursing mothers for one year after the child’s birth. This space should be “a place, other than a bathroom, that is shielded from view and free from intrusion from co-workers and the public, which may be used by an employee to express breast milk.”
